This Privacy Policy does not require any physical, electronic or digital signature. This Privacy Policy is a legally binding document between you (“User” or “You) and BRIGHT POWER STATION The terms of this Privacy Policy will be effective upon your acceptance of the same (directly or indirectly in electronic form, by clicking on the I ACCEPT tab or by use of the website/mobile application or by any other means) and will govern the relationship between You and BRIGHT POWER STATION for your use of the website www.brightpowerstation.com (“Website”) defined herein below.

This document is published and shall be construed in accordance with the provisions of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 read with Information Technology (Intermediaries guidelines) Rules, 2011 under Information Technology Act, 2000; that require publishing of the Privacy Policy for collection, use, storage and transfer of sensitive personal data or information. Please read this Privacy Policy carefully. By using the Website, in any manner you indicate that you understand, agree, accept and consent to this Privacy Policy. If you do not accept this Policy, please immediately cease your access and use of our Platforms and do not provide any personal data to us.

1. IMPORTANT INFORMATION AND WHO WE ARE

(Bright Energy) Xenal Automated Systems Nigeria Enterprises (XASNE) (referred to in this Privacy Policy as “BRIGHT POWER STATION” , “we”, “us” and “our”) is the “data controller” of your personal data. In simple terms, this means that we: (i) “control” your personal data, including making sure that it is kept secure; and (ii) make certain decisions on how to use and protect your personal data, but only to the extent that we have informed you about the use or are otherwise permitted by law.

2. METHOD OF COLLECTION OF PERSONAL INFORMATION

We may collect information from you when you visit/register on our platforms, use online forms or respond to a survey and conversations and in other correspondence (including via email and telephone). By providing us your Information or by making use of the facilities provided by the Website, You hereby consent to the collection, storage, processing and transfer of any or all of Your Personal Information and Non-Personal Information by us as specified under this Privacy Policy. You further agree that such collection, use, storage and transfer of Your Information shall not cause any loss or wrongful gain to you or any other person. Technical information (including the type of mobile device you use, a unique device identifier (for example, your device’s IMEI number, the MAC address of the device’s wireless network interface, or the mobile phone number used by the device), mobile network information, your mobile operating system, the type of mobile browser you use and time zone setting); your communication and marketing preferences; your interests, preferences, feedback and survey responses; other personal data that you submit to us, such as information you provide to register for email alerts or correspond with us in relation to inquiries; and other publicly available personal data, including any which you have shared via a public platform (such as a Twitter feed or public Facebook page).

4. HOW WE USE THE PERSONAL DATA

We will use the information and personal data for improving our sites and providing you with the most user-friendly experience when using the services including sending of welcome and periodic emails that provide details on how to use our service and the mobile applications and building a profile of your preferences so that we can ensure our services are provided when you need them in best possible way. All required information is service dependent and we may use the above said user information to, provide, maintain, protect, and improve our services (including advertising and marketing services) and for developing new services.

Provided such information will not be considered as sensitive if it is freely available or accessible in the public domain or is furnished under the Right to Information Act, 2005 or any other law for the time being in force.

Our website “www.brightpowerstation.com” uses cookies. A cookie is a small file of letters and numbers stored by phone after being sent to your phone when you visit a website. Whenever you visit the same website again, the information stored in the cookie can be retrieved to notify the website of your previous activity. 7. INFORMATION DISCLOSURE AND SHARING

We will disclose your personal data with third parties if required to do so without obtaining the prior consent of the user in following limited circumstances:

(a) When it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing these Terms; for complying with the applicable laws and regulations.

9. CHANGE AND WITHDRWAL OF INFORMATION

In the event you wish to change your personal information or if you no longer desire to use our services you may correct, delete inaccuracies or amend information by making the changes on our information page or by contacting us on our email id provided on our website or Mobile Application through your email id registered with us. We will make good efforts to make requested changes in our then active database in reasonable time. Even after your account is terminated we will retain your personal information including usage information as required to comply with our legal and regulatory obligations, resolve disputes, conclude any activities related to cancellation of account, investigate or prevent fraud or other inappropriate activity, to enforce our agreements, and for other business reason.

10. INFORMATION SECURITY

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. All information gathered on our Website is securely stored within our controlled database. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. And, of course, any information you include in a posting to the discussion areas is available to anyone with Internet access.

11. CHANGES TO THE PRIVACY POLICY

We may change or update our Privacy Policy from time to time to incorporate necessary future changes. Any changes will be effective immediately upon the posting of the revised Privacy Policy. 12. TERMINATION

In case of non compliance of Privacy Policy, we have a right to immediately terminate the access or usage rights of you and remove any non compliant information which is not in conformity to our Privacy Policy.

BRIGHT POWER STATION TERMS & CONDITIONS:

1. GENERAL

This Agreement creates binding legal obligations on you. If you do not agree to any of the terms of this Agreement, please do not access the Platforms, use any of the services offered through the Platforms or register an account for such services.

1.1. These terms and conditions constitute the agreement (“Agreement”) between you (“User”) and ( Bright Energy) Xenal Automated Systems Nigeria Enterprises (XASNE) (“we,) regarding your use of our Power Generator, and applies to our website  www.brightpowerstation.com  using operating systems such as IOS, Android, and/or Windows Mobile collectively called the “Platform”).

1.2  Your use of the Service is subject to this Agreement, our privacy policy (“Privacy Policy”) and usage rules (“Usage Policy”), which are located on the Platform. You agree to accept our Usage Policy and Privacy Policy which constitute integral parts of this Agreement.

2. USER QUALIFICATION
You warrant and represent that:

(1). you are aged 16 years or over; and have the requisite mental and legal capacity to enter into this Agreement and use the Services.

(2). any information you submit to us when using the Service is accurate, complete, and current; and

(3). your use of the Service does not violate any applicable law or regulation.

3. USER REGISTRATION

3.1 You shall register with the Platform through mobile phone verification or other procedure to become a registered user on the Platform. You acknowledge and agree that the information you provide during the user registration process is accurate and complete, and you shall promptly notify us of any changes to the information.

3.2 The user account (“Account”) you create following the registration process shall be personal to you. You may not transfer your Account to anyone else, nor permit or assist others to use the Service through your Account, except for those individuals or businesses that have been expressly authorized by us to create accounts on behalf of their employers or customers.

3.3After successfully completing the User registration process, you may start using the Service through the Platform in accordance with this Agreement.

3.4We reserve the right to suspend, deny or revoke your access to your Account, the Platform and/or the Service at any time and at our sole discretion. If you are suspended, or have been denied or had your access revoked you may lodge a User complaint in accordance with the procedures set out in this Agreement.

4. ACCOUNT SECURITY

4.1 You are responsible for the security of your Account including login information and password. Please ensure that you log out at the end of each session when using the Website and leave the Platform following the correct steps. If you disclose your Account information you may be responsible for any losses and consequences of such acts.

4.2 Subject to Clause 10.1 of this Agreement, you shall be responsible for all the actions and results carried out under your Account (including, but not limited to, using BRIGHT POWER STATION, releasing information, disclosing information, opening your address book) whether the actions and results have caused any damage to yourself, us or a third party.

4.3You must notify us via the Platform immediately if you become aware of any unauthorized use of your Account, or other situation that may cause theft or loss of your Account. Upon notice of unauthorized use, we will temporarily lock your Account, but you acknowledge that doing so takes a reasonable amount of time, and it will not be immediate.

4.4Your Account may only be used by you and may not be shared with any other person. You agree:

      - To keep your Account details private at all times;
      - To keep the login verification code to your Account safe and confidential;
      - Not to transfer any part of your Account (e.g., address book) to anyone else; and
      - To comply with all applicable laws and the terms and conditions in this Agreement in connection with your Account.

4.5You shall be responsible for all actions and transactions made through your Account unless you have closed it, or reported any misuse of your Account to us via the Platform.

5. USING THE SERVICE

5.1 Using BRIGHT POWER STATION

(a)  After registration, by clicking ‘unlock’ in the App the Power generator will be automatically released.

(b) Before you use Power generator you must carefully inspect it for any damage, including,

(c) You must promptly notify BRIGHT POWER STATION of any problem or issue with Power Generator

(d) Subject to Clause 10.1 of this Agreement, if you proceed to use Power generator in circumstances where:

      - You have been advised or otherwise informed;
      - It is visually apparent and/or
      - Your inspection indicates, that such Power generator is damaged, defective or otherwise unsuitable to be used, you will be solely responsible, and we will not be responsible for any damage or injury to your body or property or the body or property of any third party arising from the use of such Power generator

(e)You must use Power generator in a reasonable, considerate and lawful manner. You may not damage it or restrict others from using it, including, but not limited to, damaging, vandalizing, extinguishing or concealing Power generator,

(f) You must return Power generator in the same condition in which it was rented. If Power generator is returned damaged or in a state of disrepair, then you will be charged a fee that is equal to the cost of Power generator

(g) You may not hire out Power generator to anyone else, nor may you use Power generator for conducting any business activity.

(h) After each use of Power generator, you can end the rental period by returning Power generator to a station, (rental period ends automatically in the App)

6. PUBLIC LIABILITY INSURANCE
7. CHARGES AND PAYMENT

7.1 The charges for the use of the Service are as displayed on the App from time to time.

8. COMPLAINTS

8.1 1 In the event that at any time you have a complaint or dispute regarding the Service or the Platform you can notify us via the Platform or by sending an email to our customer service email

9.1 You acknowledge and agree that in order to protect the rights and interests of other users of the Platform and Power generator, we may take the following actions without notifying you in advance if we determine, in our sole and absolute discretion, that you have breached any of the terms of this Agreement:

10. LIMITATIONS OF OUR LIABILITY

10.1Nothing in this Agreement shall limit or exclude BRIGHT POWER STATION liability for:

10.2Subject to clause 10.1, you acknowledge and agree that our liability to you whether in contract, tort, for breach of statutory duty or otherwise, arising under or in connection with this Agreement shall be capped at any policy limit of such public liability insurance policy as we have in place in connection with the Service.

11. OWNERSHIP AND INTELLECTUAL PROPERTY

11.1 Your agreeing to this Agreement and becoming a User only entitles you to the Service in accordance with the terms and conditions set out in this Agreement. There is no other authorisation, cooperation, partnership or agency between you and us.

12. TERMINATION OF THIS AGREEMENT

12.1User Termination. You may terminate this Agreement in any of the following ways:

      - If you notify us via the Platform at any time that you wish to cease using the Service and the Platform;
      - If you cease using the Service and the Platform for a period of 100 consecutive days or more;
13. ELECTRONIC SIGNATURES AND NOTICES

13.1 If you have an Account with us, you agree that we may provide you any and all required notices electronically through your Account or other electronic means such as email, or pop-up messages or pushed messages on the Platform in accordance with our Privacy Policy.

14. GOVERNING LAW

14.1This Agreement and any dispute arising in relation to it shall be governed by and construed in accordance with English law and you and we agree to submit to the exclusive jurisdiction of the English courts in circumstances where the terms of this Agreement permit litigation in court.

15. FORCE MAJEURE

15.1We shall undertake basic security obligations in accordance with law, but will not be responsible for damages resulting from the maintenance of the information network equipment, connection failure, malfunction of the computer, communication or other system, power breakdown, strike, riot, fire, flood, windstorm, explosion, war, government actions, changes of laws, regulations, administrative provisions and other rules, orders of judicial or administrative authorities or acts or omissions of any third party.

16. Miscellaneous

16.1This Agreement (including but not limited to the Privacy Policy, Usage Policy and any additional terms that we have notified you of being applicable to specific services) constitutes the entire agreement between the parties with respect to its subject matter. It supersedes all previous agreements and understandings between the parties.

16.2We may assign, transfer, delegate, or otherwise sub-contract our rights under the terms of this Agreement in our sole discretion.
